空軍：復興國賠案仍待法院審理

（中央社記者陳培煌台北28日）空軍司令部今天說，與復興航空官司由高等法院審理中，基於依法行政、尊重司法判決及兼顧雙方利益，空軍司令部將依法院判決來處理。

復興航空客機民國92年間在台南機場落地時，碰撞跑道上準備施工的工程車，機體毀損。飛安會調查認定，關鍵肇因是軍方飛管室、監工及施工人員均未落實作業規定所致。

對於媒體報導「復興航空公司籲請空軍勇於負起責任，不再浪費公帑，終結復興航空國賠案」內容，空軍司令部晚間發布新聞稿表示，台灣高等法院判決空軍應負賠償責任，但復興航空公司所提賠償金額與計算方式有諸多不合理之處。

空軍司令部表示，經向最高法院提起上訴，最高法院也認有未查明之處，於是在100年11月10日判決發回台灣高等法院更審，並將在今年8月21日召開準備程序庭。1020728
