立法院院會今（6）日三讀修正通過軍事審判法部分條文，承平時期軍人犯罪回歸普通司法機關追訴、審理，洪仲丘案將可適用。對此，行政院表示感謝，並將全力做好配套。
立法院今三讀通過軍審法修法，國民黨立院黨團書記長賴士葆表示，經過朝野協商後，同意軍審法修正「一次到位、兩階段實施」。
他強調，洪仲丘案將移審到一般司法法庭，公告後「馬上生效」，同時司法單位也將成立專業法庭處理軍事案件，至於其他案件由軍法轉移到一般司法需要5個月左右的時間，「這是負責任的協商，不是草率、沖天式的修法」。
立委李貴敏說，由於軍法案件移轉到司法體系需要時間，因此協商中也納入要在5個月時間完成。
行政院發言人鄭麗文表示，非常感謝立院加速審查相關法案，未來公告後，在第一階段就可把洪案送到普通法院審判。
至於5個月的時程會不會太急迫，鄭麗文說，尊重立法院朝野協商的決定，行政院將全力做好配套。
此外，關於「軍事冤案申訴委員會」的設立，鄭麗文表示，政委羅瑩雪已開過協調會，待行政院長江宜樺核定；委員人選部分，須經推薦過程，今日應無法確定。
